[07:06] DaemonFC schestowitz[TR2]: That's ChexSystems here. [07:06] DaemonFC You end up in there on the naughty list for a few reasons. [07:06] DaemonFC They don't really give a shit how many bank accounts you open, but they log if they had an incentive. [07:07] DaemonFC If you open too many that have incentives and then ditch the bank and move on, eventually they may start denying you a bank account. [07:07] DaemonFC It's the same if you bounce checks, but obviously that's much worse. [07:07] DaemonFC Like most negative account information, it remains for 7 years from the incident. [07:07] DaemonFC So eventually you do have them "fall off" and lenders and other banks can't see that one anymore. [07:08] DaemonFC It's designed so that if you have a phase of your life where bad shit happens, the years go by and if you pay your bills and don't do anything "bad" then it hurts you less and less until finally there's no negative information anymore (hopefully). [07:09] DaemonFC So if you're 35 and you had some bad credit card charge-offs when you were 27, then those aren't listed anymore. [07:09] DaemonFC If the bad shit happened all around the same time, it'll fall off around the same time. [07:10] DaemonFC Their goal is that after spending some time in the dog house, you'll pay your bills, stop getting lumps, and they'll want to do business with you again. [07:11] DaemonFC The bankruptcies stay on your credit report for 10 years. But the accounts that went bad go away 7 years after the first delinquency. [07:12] DaemonFC So if you became delinquent on all your cards in January 2020 for example, but filed bankruptcy in August 2020, then the credit cards would fall off your credit report by December 2026, but the bankruptcy wouldn't until July 2030. [07:12] DaemonFC They all hurt you separately and combined. [07:12] DaemonFC So by the time the negative accounts fall off, your credit score isn't severely affected by the bankruptcy anymore. [07:13] DaemonFC More damage was being done by the computed score damage of like 11 credit cards and an auto loan, and maybe a mortgage and some medical bills, then just the fact you filed bankruptcy. [07:14] DaemonFC This also means you need to look and make sure they didn't make any mistakes. I had one credit card bank (Citi) that continued reporting negative information after the bankruptcy was discharged on Experian, which is illegal. [07:14] DaemonFC I complained to Experian and they removed the entire negative account history, including all the late payments and the Charge Off. [07:15] DaemonFC KIA wasn't in their office during COVID, and I disputed the accuracy of that, and it fell off two out of my three reports (Transunion and Equifax). [07:16] DaemonFC Capital One? I had a $16,000 card that defaulted by the time they charged it off, but they sold it to a collection agency, and I disputed it asking who actually owned the account in May, and they just went ahead and removed the entire account. [07:16] DaemonFC So you're not going to fix everything that way, but it certainly won't hurt. [07:17] DaemonFC It's 2-3 less adverse accounts following you around, or at least a partial fix (Citi deleting 6 months of Negative Information). [07:18] DaemonFC The lender can choose to get back in and delete the negative information, or the entire negative account. The only thing they are not allowed to do is continue reporting new negative information after you FILE for bankruptcy and get the automatic stay. [07:18] DaemonFC So they can only modify that account trade-line in ways that benefit or at least don't hurt you. [07:18] DaemonFC If they do anything after that which hurts you, they broke the law. [07:19] DaemonFC There's no law that says a lender can't remove adverse information from your credit report after-the-fact. [07:19] DaemonFC They just very rarely do it. [07:20] DaemonFC Whoever owns the account can generally put whatever they want on your report as long as it's true and doesn't violate the bankruptcy or credit reporting laws. [07:20] DaemonFC So even though they're not supposed to, sometimes they make agreements where you pay and they'll delete. [07:20] DaemonFC But you need to get it in writing that that's what they promise to do. [07:21] DaemonFC The credit bureaus don't like it, but they can't do much about it. [07:21] DaemonFC From their point of view, they're selling data on you that "helps others make risk assessments". [07:22] DaemonFC With pay-for-delete agreements, the risk assessment becomes less accurate because you've literally paid someone to delete it. [07:22] DaemonFC After you go bankrupt, you are a huge risk. But some lenders don't care. [07:23] DaemonFC They deal exclusively with these. [07:23] DaemonFC Your inbox will explode with bad credit offers. [07:23] DaemonFC Like used cars at 27% down at the Toyota dealer. [07:24] DaemonFC Most people who sign those lose the car, but they don't care. [07:24] DaemonFC They'll sell the car again while they go after you for a lot of money and you don't have the car. [07:25] DaemonFC The higher the interest rate, the more likely you are to lose the car. [07:25] DaemonFC So you need to really be laser focused on "if I do need a car loan, let's see how long I can drive the clunker". [07:26] DaemonFC The longer you can delay, the less the bankruptcy hurts you when this car craps out and you need a new one.
